ABSOLUTE AND CONDITIONAL DISCHARGES

What is an absolute or conditional discharge?

For an eligible offence, a court may grant an absolute or conditional discharge instead of entering a conviction when the statutory requirements are met. A conditional discharge includes a probation order; an absolute discharge does not. Although the Criminal Code deems a discharged person not to have been convicted, police records, immigration consequences, international travel issues, and other effects may still require separate legal advice.
