The Law Office of Kalina & Tejpal recognizes the importance of privacy and the sensitivity of personal information. We handle personal information in accordance with applicable federal and provincial privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA), and with our professional obligations as lawyers.
Information received within a lawyer-client relationship is also protected by duties of confidentiality and, where applicable, solicitor-client privilege. This policy explains how we collect, use, disclose, safeguard and provide access to personal information.
OUR COMMITMENT TO PRIVACY
We collect only the personal information reasonably required to provide legal services, administer our practice and meet our professional and legal obligations. We do not sell client information or provide client lists to third parties for marketing purposes.

Depending on the matter, personal information may include:

financial, billing and transaction information;
medical, criminal, court and regulatory records;

We collect information by lawful and fair means. We usually receive information directly from a client or prospective client. Where appropriate and permitted by law, we may also obtain information from:

employers, insurers, accountants and other professional advisers;
witnesses, experts, investigators and other parties; and
publicly available sources.
CONSENT
We seek consent where required. Consent may be express, implied through a person’s conduct, or not required where collection, use or disclosure is authorized or required by law. Consent may be withdrawn, subject to legal and professional obligations and any resulting effect on our ability to provide services.
HOW WE USE PERSONAL INFORMATION
We may use personal information to:
evaluate, accept and conduct legal matters;
provide legal advice and representation;
communicate with clients and other authorized persons;
manage conflicts, retainers, billing, accounting and collections;
engage experts, investigators, agents or other service providers;

SAFEGUARDS AND RETENTION
We use administrative, technical and physical safeguards appropriate to the sensitivity of the information. Access is limited to those who require it for legitimate professional or operational purposes.
We retain personal information only for as long as reasonably necessary to serve the identified purposes and comply with legal, professional, insurance and record-retention requirements. Information is then securely destroyed or anonymized, subject to applicable obligations.
ACCESS, CORRECTION AND COMPLAINTS
You may request access to personal information we hold about you and ask that inaccurate or incomplete information be corrected. We may decline access only where permitted by law, including where:
disclosure would reveal personal information about another person;
the information is protected by solicitor-client privilege;
disclosure could prejudice negotiations or legal proceedings;
disclosure could affect the firm’s rights or property; or
the request is frivolous or vexatious.
If we deny an access or correction request, we will explain the reason, subject to any legal restrictions.
ADDITIONAL SAFEGUARDS
We do not use a Social Insurance Number as a routine means of identifying or organizing information. Where permitted by law, we may obtain information from consumer-reporting agencies to verify identity, assess credit, prevent fraud or comply with anti-money-laundering obligations.
EMAIL COMMUNICATIONS
Email is not completely secure. Please do not send highly sensitive or confidential information by email or through a website form unless requested. By contacting us electronically, you consent to our replying through the same medium.
CHANGES TO THIS POLICY
We review this privacy policy periodically and may update it to reflect changes in our practices or legal obligations. The version posted on this website is the current version.
